Terms of Service
These Terms of Service ("Terms") govern the use of the FATE DECODER service ("Service") provided by Flowind LLC ("Company"). By registering for or using the Service, you agree to be bound by these Terms.
Article 1 — Service Overview
- The Service is an AI-powered self-understanding and reflection support tool based on Yin-Yang and Five Elements theory. It provides fate chart calculations, AI-assisted interpretation of those charts, compatibility analysis, and related features.
- The Service uses Yin-Yang, Five Elements, and stem-branch calendar concepts as cultural and interpretive frameworks for self-understanding and reflection. It does not provide definitive fate prediction, professional advice, or guaranteed future outcomes.
Article 2 — Nature of Content and Disclaimer
- The analyses, interpretations, and advice provided by the Service are generated by third-party large language models ("LLMs") provided by Anthropic PBC, DeepSeek, and other providers through their APIs. The Company does not have the technical means to verify the originality or content of these outputs.
- The Yin-Yang Five Elements interpretations provided by the Service are independently generated by AI based on its training data. They do not guarantee the orthodox or traditional interpretation of any specific school of Yin-Yang Five Elements. Multiple schools and interpretations exist within Yin-Yang Five Elements, and the Service's content does not necessarily align with the views of any particular school.
- The chart calculations (fate charts, major cycles, annual cycles, etc.) in the Service are performed by the Company's proprietary calculation tool, based on the Sexagenary Cycle calendar (originating in ancient China) and publicly known theories of Yin-Yang Five Elements. These calculation algorithms are based on publicly available knowledge to which no individual or organization holds exclusive rights, and the calculation results correspond to objective astronomical and calendrical facts.
- The interpretations and advice based on calculation results are, as stated above, content generated by LLMs and differ in nature from the objectivity of the calculation results.
- LLM-generated content has the following characteristics: (a) it may contain factual errors (hallucinations); (b) different outputs may be generated for the same input; (c) it may contain biases from training data; (d) it may not reflect the most current information. Users shall use the Service with an understanding of these AI-specific risks.
- The Company makes no guarantees regarding the accuracy, completeness, or usefulness of the content provided by the Service. Users are solely responsible for any actions or decisions made based on the content. The Service is intended for informational and self-reflection purposes and does not guarantee any specific results or effects.
Article 3 — AI-Generated Content and Copyright
- The text content of the Service is generated through APIs of third-party LLM providers (Anthropic PBC, DeepSeek, etc.). The model training and generation processes are primarily within the control of those providers. The Company does not guarantee the copyright originality or legal compliance of every output, but will respond in good faith to notices and claims relating to the Service.
- Due to the nature of the LLM generation process, the possibility that output content may unintentionally resemble third-party copyrighted works or existing publications cannot be completely excluded. The Company represents that generated content is not intended to intentionally reproduce, summarize, or adapt any specific third-party work.
- If output content is found to potentially infringe on third-party copyrights, the Company will promptly take measures such as correction or deletion of the relevant output. Copyright holders may contact us at the address provided in Article 17.
- When a copyright infringement claim is made regarding the Service's output, the Company will respond through the following process: (a) review of the claim (identification of the specific content and original work); (b) reasonable investigation of the relevant output; (c) deletion or correction of the relevant output as necessary; (d) commercially reasonable efforts to reduce recurrence, including prompt or system adjustments where appropriate. The legal determination of whether an output constitutes infringement is ultimately entrusted to judicial authorities, and the Company will comply with such determinations.
- When using content output from the Service, users shall: (a) not republish the output as-is in commercial publications or paid content; (b) independently verify that the output does not contain elements that infringe on third-party rights; (c) accept that responsibility for secondary use of the output ultimately rests with the user.
Article 4 — Recommendation to Consult Professionals
- The content of the Service does not substitute for professional advice in medicine, law, taxation, investment, management, psychotherapy, or any other specialized field. When making important decisions in these areas, users must consult qualified professionals in the relevant field.
- In particular, making the following significant decisions based solely on the Service's content is not recommended: health and medical judgments; legal dispute decisions; investment or contract decisions involving large sums of money; major life choices such as marriage or divorce; and personnel decisions such as hiring or dismissal.
Article 5 — Accounts
- Users must register with a valid email address and password. Users are responsible for maintaining the confidentiality of their credentials.
- Users may not share, transfer, or allow third parties to use their accounts.
- The Company may suspend or delete accounts that violate these Terms or are inactive for an extended period.
- By registering, you agree to receive service-related email (e.g. verification and security notices) and informational/promotional email from the Company, including an educational email series about Yin-Yang Five Elements fate reading and updates about FATE DECODER. You can stop the informational/promotional email at any time via the one-click unsubscribe link in each email; service-related email will continue.
Article 6 — Pricing and Credits
- The Service uses a credit-based billing system. Each feature consumes a specified number of credits.
- Credits can be obtained by purchasing credit packs or subscribing to a monthly plan. Prices are displayed before tax on the credits page; applicable taxes are calculated at checkout.
- Subscription credits expire at the end of the month following the month of grant. Purchased and free credits expire 180 days after purchase or grant. Refund credits may have shorter expiration periods. Details are described on the credits page.
- Payments are processed through Stripe, Inc. The Company does not directly handle or store credit card information.
- Subscribers may change their plan (upgrade or downgrade) at any time. Upgrades take effect immediately with prorated billing for the remainder of the current billing period, and credits proportional to the prorated charge are granted. Downgrades take effect at the end of the current billing period; the current plan continues until then. A scheduled downgrade may be canceled before the effective date.
- Credits have no cash value, cannot be exchanged for money, transferred, assigned, pledged, or sold, and may be revoked or suspended in cases of fraud, chargebacks, payment reversal, or violation of these Terms.
- Credits are consumed in order of earliest expiration where technically practicable. Expired credits are not restored except where required by law or where the Company determines that an error attributable to the Company occurred.
- The Company may change prices, granted credit amounts, consumed credit amounts, expiration rules, and plan contents by posting notice in advance or by otherwise reasonable means, except where urgent changes are needed for security, legal, or provider-related reasons.
Article 7 — Plans and Usage Limits
- The Service offers a free plan and paid subscription plans. Each plan has different usage limits as described on the credits page.
- The free plan has the following limitations: a maximum of 5 registered persons, a maximum of 5 AI reading histories, and no ability to save compatibility results.
- When a user's subscription expires or is canceled, free plan limits apply after the current billing period ends. If the user's saved data exceeds the free plan limits, the Company may provide an approximately one-month grace period for the user to review, export where available, or delete data. After the grace period, saved compatibility data may be deleted, registered persons exceeding the free plan limit may be deleted starting from the oldest entries, and excess AI reading histories may be deleted starting from the oldest entries.
- When downgrading from a higher-tier paid plan to a lower-tier paid plan, the usage limits of the new plan apply after the downgrade takes effect. Data exceeding the new plan's limits may be subject to the same grace period, restrictions, and deletion process described above.
Article 8 — Refund Policy
- Purchased credits are non-refundable in principle, as they are digital goods consumed upon use.
- Subscriptions can be canceled at any time. After cancellation, you will continue to have access until the end of the current billing period. No prorated refunds are provided.
- If a billing error, duplicate charge, credit non-grant, or other malfunction attributable to the Company is confirmed, the Company will respond by refund, credit correction, re-execution, or another reasonable method.
Article 9 — Prohibited Activities
The following uses of the Service are prohibited:
- Reverse engineering, scraping, or unauthorized automated access to the Service
- Reselling or commercially redistributing the Service's content or output
- Republishing the Service's output as-is in commercial publications or paid content
- Performing analysis using the birth data of third parties without their consent
- Using the Service as a basis for hiring, personnel evaluation, or discriminatory treatment
- Reselling the Service's output as "orthodox interpretations of a specific school"
- Using the Service as a basis for conducting fortune-telling as a business (a separate license agreement is required)
- Transferring, selling, lending, pledging, or otherwise disposing of credits or accounts
- Chargeback abuse, fraudulent payments, or attempts to obtain credits by improper means
- Impersonation of others or registration with false information
- Actions that impose an excessive load on the Service's infrastructure
- Any other activity that the Company reasonably deems inappropriate
Article 10 — Enforcement Measures
- When the Company determines that a user has violated or is likely to violate any provision of these Terms, including the prohibited activities set forth in Article 9, the Company may, without prior notice, take any or all of the following measures:
- Warning to the user
- Temporary suspension of all or part of the Service
- Termination or deletion of the user's account
- Forfeiture of remaining credits without refund
- Deletion of content or data related to the violation
- Users subject to enforcement measures shall not be entitled to any refund, compensation, or damages for such measures.
- The measures set forth in this article do not limit any other rights or remedies available to the Company under these Terms or applicable law, including the right to pursue legal action.
Article 11 — Intellectual Property
All content, design, code, and trademarks related to the Service are the property of the Company or its licensors. Users may not reproduce, modify, or distribute any part of the Service without prior written consent.
Article 12 — Use by Minors
Users under 18 years of age must obtain the consent of a parent or guardian before using the Service. It is not recommended that advice regarding important life decisions be left solely to the judgment of minors.
Article 13 — Service Changes and Interruptions
- The Company may modify, suspend, or discontinue the Service where necessary for operation, security, legal compliance, or business reasons. Where practicable, the Company will provide prior or prompt notice by posting on the Service or by other reasonable means.
- Changes to the Service's specifications, temporary suspension, or termination may occur due to circumstances of LLM providers, payment providers, infrastructure providers, or other third parties (such as API specification changes, pricing revisions, or service discontinuation). The Company will make commercially reasonable efforts to reduce user impact.
Article 14 — Limitation of Liability
- To the maximum extent permitted by law, the Company's total liability for any claim arising from the use of the Service shall not exceed the amount paid by the user to the Company in the 12 months preceding the claim. The Company shall not be liable for any indirect, incidental, consequential, or punitive damages.
- The limitation of liability in the preceding paragraph shall not apply to damages caused by the Company's willful misconduct or gross negligence. In such cases, the Company shall be liable for damages in accordance with applicable laws.
Article 15 — Governing Law and Jurisdiction
These Terms shall be governed by the laws of Japan. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
Article 16 — Changes to These Terms
The Company may revise these Terms at any time. Revised Terms take effect upon posting on this page. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
